In 2018, the federal government legalized hemp through the 2018 Farm Bill. This bill allows the use of industrial hemp and all its parts (including CBD), as long as the hemp provider is federally-compliant and their crops contain no more than 0.3% THC.

This finally gave residents (not just registered patients) access to CBD sourced from hemp. Residents can now legally buy, use, and possess hemp-derived CBD products without fearing any legal repercussions. This also gave them access to CBD even without a doctor’s recommendation or joining the state’s medical-marijuana program.

To be in line with the 2018 Farm Bill, the state’s lawmakers passed the New Jersey Hemp Farming Act in August 2019. This bill adopts the same standards set by the 2018 Farm Bill that, for industrial hemp to be considered legal, it must contain no more than 0.3% THC by dry weight.

Can I legally buy cannabis in NJ?

Yes. It is legal for anyone 21 years and older to buy cannabis at a dispensary licensed to operate in the State of New Jersey. Individuals with a qualifying medical condition may participate in the Medicinal Cannabis Program.

What can I legally buy?

In each transaction, dispensaries are allowed to sell up to the equivalent of 1 ounce of cannabis. That means up to :

For equivalency purposes, depending on how the product is manufactured, tinctures are considered “concentrates in a solution.” Topicals fall under the category of “other liquid forms.” Syringes fall under the category of “ingestible products.”

Equivalency is based on total weight of the product sold. For products containing both THC and CBD, equivalency is based on the total weight of the concentrate. For example, a product containing 400mg of CBD and 100mg of THC has a total weight of 500mg or 0.5 grams.

Reminder: The law allows adults 21 years and older to be in possession of 1 ounce total of cannabis and cannabis products.

Can I legally grow cannabis at home?

No. Current New Jersey law does not give authority to NJ-CRC to authorize private, residential, or any growing of cannabis outside of a business with a cultivation license.
